COPYRIGHT & INTELLECTUAL PROPERTY POLICY
SimFly Pte. Ltd. – Last updated: 29 May 2025
This Policy sets out how SimFly Pte. Ltd. (“SimFly”, “we”, “our”) protects its intellectual property and how you may use SimFly materials. It also explains the procedure for submitting infringement claims.
1 PURPOSE AND SCOPE
This Policy applies to every visitor, User, Affiliate or content creator who accesses simfly.io, its sub‑domains, the SimFly client, community forums, or any other SimFly Service (the “Services”). It forms part of the legally binding Terms and Conditions.
2 OWNERSHIP OF SIMFLY INTELLECTUAL PROPERTY
2.1 Original Works. All text, artwork, logos, design elements, software code, sound, video, flight‑simulation data and other creative content incorporated in the Services (“SimFly Content”) are either owned by or licensed to SimFly and are protected under Singapore and international copyright, trademark and unfair‑competition laws.
2.2 Trademarks. “SIMFLY”, “Take Off and Get More”, “Fly to Earn”, “fly2earn”, “Fly & Earn” and any related stylisations or logos are trade marks or registered trade marks of SimFly Pte. Ltd. They may not be used without our prior written permission except as expressly permitted under section 7 (Fan Content).
3 USER‑GENERATED CONTENT (UGC)
3.1 Licence to SimFly. By uploading, streaming or otherwise making content available via the Services, you grant SimFly an irrevocable, worldwide, perpetual, royalty‑free licence (with right to sublicense) to host, reproduce, adapt, publish, translate, perform, display and distribute that content in connection with operating and promoting the Services.
3.2 Your Warranties. You represent that you own or hold the necessary rights to all UGC you submit and that it does not infringe any third‑party rights or applicable law.
4 FAN CONTENT & COMMUNITY USE
We encourage streaming, screenshots and videos that showcase SimFly gameplay, provided that:
(a) the content is primarily non‑commercial (monetised streams and ads on user‑generated videos are allowed);
(b) you include clear and visible credit to “SimFly” and do not imply an official partnership;
(c) you do not misrepresent SimFly data or leak unreleased assets;
(d) you comply with all other SimFly policies.
SimFly reserves the right to revoke permission for any reason.
5 REPORTING COPYRIGHT INFRINGEMENT
5.1 Notice Requirements. If you believe material hosted by SimFly infringes your copyright, send a written notice to info+copyright@simfly.io that includes: (i) identification of the copyrighted work, (ii) the URL or location of the allegedly infringing material, (iii) your contact details, (iv) a statement under penalty of perjury that you believe the use is unauthorized, and (v) your physical or electronic signature.
5.2 Repeat Infringers. SimFly terminates accounts of Users who are determined to be repeat infringers.
6 WEB3 / BLOCKCHAIN ASSETS
If SimFly migrates certain digital items to a blockchain (see Section 5.1 of the Terms and Conditions), ownership of the on‑chain token will pass to the User, but all underlying artwork, data and brand assets remain SimFly Content and are licensed, not sold. Token holders may display, transfer or resell the token subject to these licence restrictions.
7 USE OF SIMFLY ASSETS BY THIRD PARTIES
Commercial use of SimFly Content, including merchandise, NFTs, or software integrations, requires a separate written licence from SimFly. Unauthorised commercial exploitation is strictly prohibited.
8 FAIR USE & EDUCATIONAL EXCEPTIONS
Limited excerpts of SimFly Content may be reproduced for commentary, criticism, news reporting, teaching or research where such use qualifies as “fair use” or an equivalent exception under applicable law. You are responsible for ensuring your use falls within those limits.
9 UPDATES TO THIS POLICY
SimFly may modify this Policy at any time. The “Last updated” date will change when revisions are posted. Material changes will be announced via the Services. Continued use of the Services after the effective date constitutes acceptance of the revised Policy.
10 GOVERNING LAW
This Policy is governed by the laws of the Republic of Singapore and subject to the exclusive jurisdiction of the Singapore courts.
